1. Introduction

1.1 Company Identification

This Privacy Policy is provided by Treelink Technologies, Inc. ("Treelink," "we," "us," or "our"), a Delaware corporation with its principal place of business in Fremont, California.

1.2 Overview of Services

Treelink provides software consulting, product design, and application (MVP and full-scale) development services to startup and enterprise clients. This Privacy Policy describes how we collect, use, and share information in connection with our website, www.treelinktechnologies.com (the "Site"), and our general business operations. This Privacy Policy is incorporated by reference into our Terms of Service, available at www.treelinktechnologies.com/terms.

1.3 Scope of This Policy

This Policy applies to information we collect through the Site, including via our contact and quote-request forms, and information we collect in the course of our general business relationships with prospective and current clients, vendors, and partners. It does not apply to data we process on behalf of a client while performing Professional Services (for example, end-user data within an application we build for a client). That processing is governed by the applicable client Services Agreement and any related data processing addendum; our client, not Treelink, is typically responsible for privacy notices to its own end users.

By using the Site, you acknowledge that you have read and understood this Privacy Policy and our Terms of Service. If you do not agree with this Policy, please do not use the Site. Nothing in this Policy creates any right or remedy for you beyond what is expressly stated here, and our liability in connection with this Policy is governed by the Limitation of Liability provisions of our Terms of Service.

2. What We Mean by "Personal Information"

For purposes of this Privacy Policy, "personal information" means any information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, with a particular individual, whether alone or combined with other information we hold.

3. Information We Collect

3.1 Information You Provide

  • Contact and Inquiry Information: When you submit a "Get Quote" or contact request, or otherwise reach out to us, we collect your name, email address, phone number, company name, and any project details or messages you include.
  • Communications: Information you provide when you correspond with us by email, phone, or otherwise, including any record of that correspondence that we keep.
  • Application and Vendor Information: If you apply for a position with us or seek to become a vendor or partner, we collect the information you submit, such as a resume, references, or company information. See Section 16 (Job Applicant and Vendor Data).

3.2 Information Collected Automatically

  • Device Data: IP address, browser type, operating system, device identifiers, and similar technical qualifiers.
  • Usage Data: Search terms entered, pages viewed, time spent on pages, referring and exit pages, and click-stream data.
  • Network and Internet Information: Bounce rates, number of sessions, and similar network-level data.
  • Cookies and Similar Technologies: We and our service providers use cookies, pixels, web beacons, and similar technologies to operate the Site and understand how it is used. See Section 5 (Cookies and Tracking Technologies).

3.3 Information from Third Parties

We may receive information about you from analytics providers, advertising or marketing partners, and publicly available sources (for example, professional networking sites), which we may combine with information we collect directly.

3.4 Sensitive Personal Information

We do not intentionally collect sensitive personal information (such as government identification numbers, precise geolocation, health information, or biometric data) through the Site. Please do not submit sensitive personal information through Site forms unless specifically requested by us.

4. How We Use Information

We use the information we collect to:

  • Respond to inquiries and quote requests and communicate with prospective and current clients;
  • Operate, maintain, secure, and improve the Site;
  • Understand how visitors use the Site through analytics, and generate aggregate data about Site usage;
  • Send marketing communications about our services, where permitted and consistent with your preferences;
  • Evaluate job applications and vendor or partner proposals;
  • Detect, prevent, and address fraud, security incidents, and misuse of the Site;
  • Resolve disputes and enforce our Terms of Service; and
  • Comply with applicable legal obligations, requests, and processes.

5. Cookies and Tracking Technologies

We use the following categories of cookies and similar technologies on the Site:

  • Required Cookies: Necessary for the Site to function properly, such as enabling navigation and secure access to certain features. Because required cookies are essential to operate the Site, there is no option to opt out of these cookies through the Site itself, though you may block them at the browser level as described below.
  • Analytics Cookies: Such as those from Google Analytics or similar tools, used to understand how visitors use the Site and to improve it. Google Analytics collects data such as time of visit, pages viewed, time spent on the Site, IP address, and device/operating system type. You can opt out of Google Analytics using the browser add-on available at https://tools.google.com/dlpage/gaoptout.
  • Pixels, Web Beacons, and Similar Technologies: We and our service providers may use these in connection with the Site and email communications to track actions, measure the effectiveness of marketing, and compile aggregate usage statistics.

Most browsers let you refuse or delete cookies through their settings; doing so may affect Site functionality.

6. How We Share Information

We do not sell your personal information. We may share information with the following categories of recipients:

  • Service Providers: Such as website hosting and cloud infrastructure providers, analytics providers, email and CRM platforms, and IT support providers, under contractual confidentiality and data-protection obligations;
  • Professional Advisors: Such as legal and accounting firms, as needed;
  • Corporate Transactions: In connection with a merger, acquisition, financing, corporate reorganization, or sale of assets, in which case we will notify affected individuals as required by law;
  • Public Authorities: When required by law, subpoena, or other legal process, or to protect the rights, property, or safety of Treelink, its officers, directors, employees, clients, or others; and
  • With Consent: With your consent or at your direction.

7. Data Security and Breach Notification

We use industry-standard administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, use, disclosure, or destruction, including encryption of data in transit, access controls, and periodic security reviews, and we train our personnel on privacy and security practices. However, we cannot guarantee that unauthorized third parties will never be able to defeat these measures, and no method of transmission or storage is completely secure.

In the event of a security incident involving unauthorized access to your personal information that triggers a notification obligation under applicable law, we will notify affected individuals and any required regulators without undue delay and in accordance with applicable law.

8. Data Retention and Deletion

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to maintain business records, respond to inquiries, resolve disputes, and comply with legal, accounting, and tax obligations. Contact and inquiry information submitted through the Site is generally retained for up to three (3) years from your last interaction with us, unless you request earlier deletion or a longer period is required by law.

Upon a verified deletion request, we will delete or de-identify the applicable personal information within a reasonable time, and in any event within the timeframe required by applicable law, except where retention is necessary to comply with a legal obligation, resolve a dispute, or enforce our agreements.

9. Children's Privacy

The Site is intended for business audiences and is not directed to, and we do not knowingly collect personal information from, children under 13 (or the applicable age of consent in your jurisdiction). If we learn that we have inadvertently collected information from a child, we will take steps to delete it. If you believe we have collected information from a child, please contact us using the information in Section 20 (Contact Us).

10. Your Privacy Rights

10.1 General Rights

Depending on your location, you may have the right to request access to, correction of, or deletion of your personal information, and to object to or restrict certain processing. To exercise these rights, contact us at admin@treelinktechnologies.com. We may need to verify your identity before fulfilling your request, and we will not discriminate against you for exercising your rights.

10.2 California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:

  • Right to Know: You may request that we disclose the categories of personal information we have collected about you, the categories of sources from which we collected it, the business or commercial purpose for collecting it, the categories of third parties with whom we share it, and the specific pieces of personal information we hold about you.
  • Right to Delete: You may request that we delete personal information we have collected from you, subject to certain exceptions permitted by law.
  • Right to Correct: You may request that we correct inaccurate personal information we maintain about you.
  • Right to Opt Out of Sale or Sharing: We do not sell or share personal information for cross-context behavioral advertising, and have not done so in the preceding twelve (12) months. If our practices change, we will update this Policy and implement any required opt-out mechanism.
  • Right to Limit Use of Sensitive Personal Information: You may limit our use of your sensitive personal information, to the extent we collect any.

Authorized Agents: You may designate an authorized agent to submit a request on your behalf. We may require the agent to provide proof of authorization and require you to separately verify your own identity with us.

Submitting Requests and Our Response: You may submit a request to know, delete, or correct by emailing admin@treelinktechnologies.com. We will acknowledge receipt of your request within ten (10) days and will respond within forty-five (45) days, unless we require additional time (up to a total of ninety (90) days), in which case we will notify you of the extension and the reason for it. Any disclosures will cover the twelve (12) months preceding a verifiable request. We do not charge a fee to process a verifiable request unless it is excessive, repetitive, or manifestly unfounded, in which case we will explain why and provide a cost estimate before proceeding.

Right to Non-Discrimination: We will not deny you goods or services, charge different prices or rates, provide a different level or quality of goods or services, or suggest that you may receive different treatment, because you exercised your rights under the CCPA.

10.3 Other U.S. State Privacy Rights

If you are a resident of Virginia, Colorado, Connecticut, Utah, or another state with a comprehensive consumer privacy law, you may have rights similar to those described above, including the right to confirm whether we process your personal data, access or obtain a copy of it, correct inaccuracies, request deletion, and opt out of targeted advertising, the sale of personal data, or certain profiling. 10.4 Marketing Opt-Out

You may opt out of marketing emails at any time by using the unsubscribe link in the communication or by contacting us at admin@treelinktechnologies.com.

11. European Economic Area, United Kingdom, and Switzerland

If you are located in the European Economic Area, United Kingdom, or Switzerland, the following applies. We process personal data on the following legal bases: your consent, our legitimate interests (such as responding to inquiries and operating and securing the Site), performance of a contract, and compliance with our legal obligations. You have the right to access, rectify, or erase your personal data, restrict or object to processing, request portability of your data, withdraw consent at any time, and lodge a complaint with your local data protection authority.

Because Treelink is based in the United States, personal data transferred from the EEA, UK, or Switzerland to the United States is transferred pursuant to appropriate safeguards, such as the European Commission's Standard Contractual Clauses or the UK's International Data Transfer Addendum, where required by law.

12. Do Not Track

Treelink does not track visitors over time and across third-party websites to provide targeted advertising, and the Site does not currently respond to browser "Do Not Track" (DNT) signals, as there is no common industry standard for recognizing and responding to them.

13. Testimonials and Case Studies

With your consent, we may publish testimonials, project outcomes, or case studies that include your name, company, role, and quotes you provide. You may withdraw consent for future use of this information at any time by contacting us; withdrawal will not affect materials already published where removal is not reasonably practicable.

The Site may link to third-party websites, including our social media pages and case-study or portfolio references, and may allow you to interact with us through third-party accounts. We do not control these third parties and are not responsible for their privacy practices; your interactions with them are governed by their own privacy policies, and we encourage you to review those policies before using their services.

15. Job Applicant and Vendor Data

If you apply for a position with Treelink or submit information as a prospective vendor or partner, we use that information to evaluate your application or proposal, communicate with you, and, if applicable, conduct standard due diligence or reference checks. We retain applicant and vendor information for as long as reasonably necessary for these purposes and as permitted by applicable law.

16. International Data Transfers

Treelink is based in the United States. If you access the Site from outside the United States, your information may be transferred to, stored, and processed in the United States, which may have data protection laws different from those of your country. By using the Site, you consent to this transfer, storage, and processing.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time, in our sole discretion, to reflect changes in our practices or for other operational, legal, or regulatory reasons. Material changes will be reflected by updating the "Last Modified" date above and, where appropriate, posting a notice on the Site. We will try to notify you of material changes, but are not liable for any failure to do so. Your continued use of the Site after changes are posted constitutes acceptance of the updated Policy.

18. Confidentiality

We take the confidentiality of information seriously. Any technical, financial, strategic, or other proprietary and confidential information relating to Treelink's business that becomes available to you in connection with the Site is Confidential Information and should not be disclosed to third parties or used other than as contemplated by these policies.

19. Governing Law

This Privacy Policy is governed by, and any dispute arising out of or relating to it is subject to, the dispute resolution and governing law provisions of our Terms of Service, available at www.treelinktechnologies.com/terms.
